DumpFun Terms of Use

These Terms of Use constitute a legally binding agreement between you ("you" or "your") and KOLXIS ENTERPRISES LTD, hereinafter DumpFun ("DumpFun", "we", "our" or "us"). The Terms govern your use of the DumpFun Services made available to you on or through the Platform or otherwise. DumpFun Services may be provided by DumpFun or any DumpFun Affiliate. By accessing the DumpFun Platform and/or using the DumpFun Services, you agree that you have read, understood and accepted these Terms, together with any additional documents.

You acknowledge and agree that you will be bound by and will comply with these Terms, as updated and amended from time to time. If you do not understand and accept these Terms in their entirety, you should not use the DumpFun Platform.

  1. Risk Warning

    The value of Digital Assets can fluctuate significantly and there is a material risk of economic loss when buying, selling, holding or investing in Digital Assets. You should therefore consider whether trading or holding Digital Assets is suitable for you taking into account your personal circumstances, financial or otherwise. Please ensure that you fully understand the risks involved before using the DumpFun Platform and DumpFun Services.

    You acknowledge that we are not your broker, intermediary, agent or advisor and we have no fiduciary relationship or obligation to you in connection with any activities you undertake when using the DumpFun Platform. We do not and are not providing any investment or consulting advice and no communication or information that we provide to you is intended to be, or should be construed as, advice of any kind.

    You are responsible for determining whether any investment, investment strategy or related transaction is appropriate for you in light of your personal investment objectives, financial circumstances and risk tolerance and you are responsible for any associated loss or liability. We do not recommend that any Digital Asset should be bought, earned, sold or held by you.

    Before making the decision to buy, sell or hold any Digital Asset, you should conduct your own due diligence and consult your financial advisor. We are not responsible for the decisions you make to buy, earn, sell or hold Digital Assets based on the information or services provided by us, including any losses you incur arising from those decisions.

  2. Introduction

    DumpFun is a platform designed to assist with the creation and trading of Digital Assets.

    By using the DumpFun Platform you are entering into a legally binding agreement with us. These Terms will govern your use of the DumpFun Platform.

    You must read these Terms, together with the documents referenced in the Terms, carefully and let us know if you do not understand anything.

    You acknowledge that you will be bound by, and agree that you will comply with, any relevant additional terms and conditions that apply to your use of the DumpFun Platform.

  3. Cookies & Similar Technologies

    When you visit the DumpFun Platform, we may automatically collect certain information about your device using cookies and similar technologies. This may include information about your web browser, IP address, login times, browser plug-ins, device type, and location information.

    Additionally, as you browse the Site, we may collect information about the web pages you view, your navigation patterns, and referral data.

  4. Creator-Specific Terms of Service

    If you use the DumpFun Platform to launch a token ("Creator"), you agree to the following additional terms:

    1. You are solely responsible for the smart contract parameters (e.g., sell lock, fees, tax routing).
    2. You will not create or launch tokens that involve deception, misleading claims, illegal activity, or content that is hateful, discriminatory, or otherwise violates applicable law.
    3. You are responsible for fully disclosing mechanics that may impact a user’s ability to sell, trade, or withdraw tokens.
    4. You acknowledge that token launches are permanent and non-reversible. DumpFun cannot remove or modify live contracts.
    5. You release DumpFun and its affiliates from any claim arising from the performance, perception, or failure of your token or any disputes with participants.
    6. You agree to indemnify and hold harmless DumpFun from all claims arising from your use of the Platform to launch or promote tokens.

  5. Disclaimers

    The DumpFun Platform is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

    We make no warranties or representations about the accuracy or completeness of content on the Platform or the content of any linked third-party websites and assume no liability or responsibility for:

    1. Errors or inaccuracies in content;
    2. Personal injury or property damage resulting from your access to or use of the Platform;
    3. Unauthorized access to or use of our servers and/or any personal information stored therein;
    4. Bugs, viruses, trojan horses, or the like transmitted through the Platform;
    5. Loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Platform.

  6. Limitation of Liability

    To the maximum extent permitted by applicable law, DumpFun, its affiliates, and their respective directors, officers, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from:

    1. Your access to or use of or inability to access or use the Platform;
    2. Any conduct or content of any third party on the Platform;
    3. Any content obtained from the Platform;
    4. Unauthorized access, use or alteration of your transmissions or content.

  7. End User License Agreement (EULA)

    By using the Platform, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal or internal business use in accordance with these Terms.

    You shall not:

    1. Copy, modify, or create derivative works based on the Platform;
    2. Disassemble, decompile, or reverse engineer the Platform;
    3. Use the Platform for any unlawful purpose or in violation of any applicable laws;
    4. Rent, lease, or sublicense access to the Platform.
    5. All rights not expressly granted are reserved by DumpFun.

  8. Governing Law and Cyprus Jurisdiction

    These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of Cyprus.

    You agree that the courts of the Republic of Cyprus shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation. For clarity, proceedings may be brought in the competent District Courts of Cyprus (e.g., Nicosia District Court).

  9. Changes and Updates

    We reserve the right to amend these Terms at any time. Changes will be posted on the Platform with an updated effective date. Continued use of the Platform after such changes constitutes your acceptance of the new Terms.
